Google requests court to dismiss Nigerian’s $150 million damages suit
Google has requested the Federal High Court in Abuja to dismiss a $150 million lawsuit brought against it and GoDaddy.com by a Nigerian, Mr. Chianugo Peter.
Google, the second defendant, argued that Peter’s claims were without merit and should be dismissed, as stated in its defense filed on November 10 by its lawyer, Mark Mordi, SAN.Peter had filed the suit on April 14, alleging the shutdown of his YouTube Audio domain name after eight years of promotional and marketing efforts.
He sought a declaration that he registered the YouTube Audio business name and commenced trademark registration on the logo.

Additionally, he claimed compensation for the loss of brand and goodwill associated with the domain name.In response, Google argued that Peter did not act in good faith, pointing out that he approached them before commencing operations, acknowledging Google’s rights.
Google contended that Peter lacked a bona fide claim to use or register any mark similar to the ‘YOUTUBE’ trademark, of which Google is the international owner.
During the court proceedings, GoDaddy had not appeared, and Google’s statement of defense was acknowledged. An extension of time was granted for GoDaddy to regularize its processes.
The court adjourned the matter until February 12, 2024, and directed the issuance of a hearing notice to GoDaddy.
