TECHDIGEST – The Nigerian government has approved Zettabytes Technologies Limited to supply eye-scanning lie detector valued at over N498 million and R-SET Integrated Solution Limited to supply digital night vision googles worth N570,825 million allowing the National Drug Law Enforcement Agency (NDLEA) to intensify the war against drug barons.

The Federal Executive Council (FEC), Nigeria’s highest decision-making body, approved about N1.06 billion for the entire project, Minister of Justice and the Attorney General of the Federation, told the media in Abuja on Wednesday after the Council meeting, chaired by President Muhammadu Buhari.

An eye-scanning lie detector is a revolutionized truth-telling technology much advanced that the traditional polygraph. The digital technology tells if a person is lying by tracking their eye movements. Eye Detect, one of its latest variants. is an advanced technology that measures bio-cognitive responses in the eye to determine deception or lies. It responds to eye movement, changes in pupil diameter, blinks, and fixations that typically signify stress.

Eye Detect technology, or eye-scanning lie detector, has won its supporters in the field. Law-enforcement agents laud the system as smoother than a traditional polygraph.

Eye Detect has an accuracy rating of up to 90% and according to the American Polygraph Association (APA) polygraphs have an accuracy rating of 83%, when done correctly.

A worrying spike in local illicit drug use and increasing fear of Nigeria becoming a major transit route has forced authorities in Abuja to deploy a more determined approach to taming drug barons.

“Arising from the fact that they have been doing wonderfully well, in terms of dealing with the scourge associated with drugs, the Federal Government has considered the possibility of making added provisions and employing and deploying technological equipment, skills and competencies that will assist them in delivery, said Malami

Adding: “As you rightly know, the National Drugs Law Enforcement Agency is an agency of government, saddled with the responsibility of exterminating illicit drugs trafficking, sales and consumption.”

According to him: “Our technology has improved to the extent that we have in place technological equipment that has the capacity to detect whether you are indeed speaking the truth or indeed you are lying in the course of investigation.

Government is determined to eradicate the illicit drug scourge, Malami said. His words:

“So, for the purpose of enhancing the capacity of the NDLEA in exterminating illicit drug trafficking, sales, and consumption, the Federal Government has considered the need and possibility of indeed providing this equipment to NDLEA.

“So, the memo in that respect was presented, it was taken and the contract was approved for Messrs Zettabytes Technologies Limited to procure for the agency this lie detector equipment.

“On that account, the Federal Executive Council approved the award of contract for the supply of eye-scanning lie detector by the NDLEA in favour of Messrs Zettabytes Technologies Limited in the sum of N498,850,000 only, inclusive of 7.5% VAT with a completion period of 90 days.

“The second memo sought the approval of the council for the supply of digital night vision goggles. This is intended to support the night operations of NDLEA.

“The council graciously approved the award of the contract with the supply of digital night vision goggles in favour of Messrs R-SET Integrated Solution Limited in the sum of N570,825,000 only, inclusive of 7.5% value-added tax with a completion period of weeks.”

The judiciary has the responsibility to sustain efficiency, effectiveness, and the timely delivery of justice to all members of society, regardless of their statuses.
Digital technology is gradually making an incursion into the judiciary to enhance greater efficiency and convenience in the administration of the justice system by helping to remove some of the limitations in the old way it functioned.
Several manual procedures in courts have been phased out and replaced by digital/electronic processes in North America, Europe, and a few Middle East countries like Qatar and the United Arab Emirates, while China is expected to digitalise its courtrooms by 2025.

The maintenance of court records, filing of pleadings and orders, and the emergence of state-of-the-art courtrooms for the presentation of evidence are important aspects of the judicial system that have been impacted by digital technology.
Nigerians are full of anticipation as they look forward to the eventual commencement of virtual court proceedings in all correctional centres across the federation.

Their expectations are based on the announcement by the Attorney General of the Federation and Minister of Justice, Abubakar Malami, to the effect that a pilot of the virtual court proceedings will hold in the Kuje Correctional Centre, Abuja this week.

Malami revealed that this strategic initiative by his office, in collaboration with the Presidential Committee on Correctional Reforms and Decongestion, to enable the taking of the evidence of suspects without their physical presence in court is in order to avoid delays in the justice system.
Also, this forms part of steps to the implementation of the Post-COVID-19 Justice Sector Plan of the Federal Government, which is geared towards building lasting reforms in the criminal justice sector in Nigeria.

It is a creditable effort aimed at improving the efficiency and speed of the delivery of justice by leveraging the transformative powers of digital technology to facilitate the ongoing reforms in the administration of justice.
But the reluctance of the justice sector to adopt innovations had contributed to the perception by the masses that access to justice is reserved only for the well-to-do, and influential members of the public.
In recognition of this negative image, the Minister of Communications and Digital Economy, Mr Isa Pantami had advised the judiciary to deploy artificial intelligence (AI) and other emerging technologies to achieve the speedy dispensation of justice in our courts.

Speaking at a recent seminar on ‘Banking and Related matters for Judges’, Pantami emphasised the need for judges to acquire digital skills and leverage technology to provide efficient and the expeditious delivery of justice to decongest courts, Police stations, and correctional facilities.

“We live in a world that is increasingly integrated with technology, and it is very difficult to separate our online life and offline life, and everything we do is being captured, processed, and stored by these big tech companies. We need to utilise our time to develop new ideas that will improve our court proceedings.

“Before, humans can think and make decisions but today we have systems that can make decisions like the way we do by using available data. Artificial Intelligence has powers, and these powers can be used against or for social justice, criminal justice and many more, so we need to design a system with legal minds that can solve courts challenges”, Pantami advised.
Speaking at a different forum in September, the Director-General of the National Information Technology Development Agency (NITDA), Inuwa Kashifu Abdullahi, had drawn the attention of lawyers to the imperative of adopting AI in their practices

Abdullahi told young lawyers at The Young Wigs Conference in Kano to fashion out ways of using technology to augment and facilitate the seamless analysis of documents, better resource management, and up-to-date levels of customer/client experiences.

He, therefore, challenged the young wigs to explore available opportunities as sources of inspiration to consider innovative ways on how AI could be deployed to boost legal services and help clients accordingly.

The successful implementation of the virtual court proceedings project would require the collective efforts of NITDA, the Ministry of Justice, Ministry of Interior, and other relevant agencies/institutions, as well as civil society organisations.

Adequate digital infrastructure must be developed to ensure the availability of good internet connectivity and wifi, otherwise, the virtual court proceedings will not achieve the desired goal.

Additionally, of greater importance is the need to expose judges and other staff to training on the use of digital technologies to enable them to utilise these tools effectively.

If properly implemented, this innovative deployment of technology, would, to a large extent, reduce the high volume of pending cases, cut trial length, enhance accessibility to judicial services, and significantly improve the pace and quality of justice in Nigeria.

Nigerians are anxiously awaiting the virtual court proceedings to commence because digital justice would offer courts archiving and retrieval systems for searching, analysing, and storing legal documents that would boost efficiency, transparency, save cost and make it easy to access and use information conveniently.

TECH DIGEST – The Federal Government has told a Federal High Court in Lagos that it has not stopped Nigerians from using social media platform, Twitter, adding that many Nigerians are still using it every day.

According to a report by the PUNCH newspaper, the Attorney-General of the Federation, Abubakar Malami, and the Federal Government said this in a counter-affidavit they deposed to in response to an originating motion filed by human rights lawyer, Inibehe Effiong.

The government had on June 4, 2021, suspended Twitter barely two days after the social media platform deleted a tweet by the President, Major-General Muhammadu Buhari (retd.).

However, many Nigerians have bypassed the Twitter suspension by using Virtual Private Network.

Malami in a statement threatened to prosecute Nigerians still using the platform while the National Broadcasting Commission ordered all radio and television stations to stop using Twitter or picking content from the platform.

Rights lawyer, Effiong, subsequently sued the Minister of Information and Culture, Lai Mohammed, Malami, and the Federal Government for suspending the social media platform.

In the fundamental human rights suit marked FHC/L/CS/542/2021, Effiong is seeking nine reliefs, including an order of perpetual injunction restraining the respondents from further suspending, deactivating or banning the operation and accessibility of Twitter or any other social media service in Nigeria because the act was in violation of his rights.

Effiong asked the court to declare as illegal the threat of criminal prosecution by Malami and Lai Mohammed against Nigerians who ‘violate’ the suspension or ban of Twitter, despite the absence of any written law.

In an affidavit deposed to by Mr. Ilop Lawrence on behalf of the Federal Government and the AGF, it was stated that the suspension of Twitter was not an abuse of human rights because Nigerians were still using Twitter despite the suspension.

It read in part, “The applicant (Effiong) and the class he seeks to represent can still operate those Twitter accounts from anywhere in the world and even from Nigeria. Nigerians are still tweeting, even at this moment as the ban on Twitter is not aimed at intimidating Nigerians or an infringement on the rights of Nigerians to express their opinion.

“The respondents (Federal Government and AGF) have never stopped the applicant (Effiong) and the class of persons he seeks to represent from voicing their opinions to access government information and offer criticism where necessary.”

The government told the court that Nigerians are still free to use other platforms like WhatsApp, Facebook, Tiktok and others.

The Federal Government also denied knowledge of Twitter deleting Buhari’s tweet on the Biafra civil which offended many Nigerians.

It said Twitter had made its platform accessible to elements like Nnamdi Kanu, the leader of the Indigenous People of Biafra; and had supported the #EndSARS protests of October 2020 which was later hijacked by hoodlums.

The government further stated that Nigerians should direct their anger at Twitter and not the government because Twitter would not have been suspended if it complied with Nigeria’s laws.

It told the court that the Twitter suspension would be lifted once the platform registers with the NBC and the Corporate Affairs Commission.

TECH DIGEST – The ECOWAS Court of Justice in Abuja in a landmark ruling today “restrained the government of President Muhammadu Buhari and its agents from unlawfully imposing sanctions or doing anything whatsoever to harass, intimidate, arrest or prosecute Twitter and/or any other social media service provider(s), media houses, radio and television broadcast stations, the Plaintiffs and other Nigerians who are Twitter users, pending the hearing and determination of this suit.”

The ruling followed the suit filed against the government by Socio-Economic Rights and Accountability Project (SERAP) and 176 concerned Nigerians arguing that “the unlawful suspension of Twitter in Nigeria, criminalization of Nigerians and other people using Twitter have escalated repression of human rights and unlawfully restricted the rights of Nigerians and other people to freedom of expression, access to information, and media freedom in the country.”

The ECOWAS court gave the order after hearing arguments from Solicitor to SERAP, Femi Falana SAN, and lawyer to the government Maimuna Shiru.

According to the ECOWAS, “The court has listened very well to the objection by Nigeria. The court has this to say. Any interference with Twitter is viewed as inference with human rights, and that will violate human rights.

“Therefore, this court has jurisdiction to hear the case. The court also hereby orders that the application be heard expeditiously. The Nigerian government must take immediate steps to implement the order.”

This development was disclosed today by SERAP deputy director Kolawole Oluwadare.

Reacting to the ruling, Femi Falana, SAN said: “The intervention of the ECOWAS Court is a timely relief for millions of Nigerians using Twitter who have been threatened with prosecution under the provision of the Penal Code relating to sedition.”

“Contrary to the assurance credited to the Attorney General of the Federation and Minister of Justice Mr Abubakar Malami, SAN that violators of the Twitter would not be prosecuted, the Federal Government filed processes in the ECOWAS Court threatening to prosecute Nigerians using Twitter for violating the suspension under the provisions of the Penal Code relating to sedition.”

“It is extremely embarrassing that the Federal Government could threaten to jail Nigerians for sedition, which was annulled by the Court of Appeal in 1983, in the case of Arthur Nwankwo vs The State.”

The suit and the ruling followed the suspension of Twitter by the Minister of Information and Culture, Lai Mohammed after the social media giant was banned in the country for deleting President Muhammadu Buhari’s tweet. The National Broadcasting Commission (NBC) also ordered TV and radio stations to “suspend the patronage of Twitter immediately”, and told them to delete ‘unpatriotic’ Twitter.

The substantive suit has been adjourned to 6th July 2021 for hearing of the substantive suit.

It would be recalled that SERAP and the concerned Nigerians had in the suit No ECW/CCJ/APP/23/21 sought “An order of interim injunction restraining the Federal Government from implementing its suspension of Twitter in Nigeria, and subjecting anyone including media houses, broadcast stations using Twitter in Nigeria, to harassment, intimidation, arrest and criminal prosecution, pending the hearing and determination of the substantive suit.”

The suit, read in part “if this application is not urgently granted, the Federal Government will continue to arbitrarily suspend Twitter and threaten to impose criminal and other sanctions on Nigerians, telecommunication companies, media houses, broadcast stations and other people using Twitter in Nigeria, the perpetual order sought in this suit might be rendered nugatory.”

“The suspension of Twitter is aimed at intimidating and stopping Nigerians from using Twitter and other social media platforms to assess government policies, expose corruption, and criticize acts of official impunity by the agents of the Federal Government.”

“The free communication of information and ideas about public and political issues between citizens and elected representatives is essential. This implies a free press and other media able to comment on public issues without censor or restraints, and to inform public opinion. The public also has a corresponding right to receive media output.”

“Freedom of expression is a fundamental human right and the full enjoyment of this right is central to achieving individual freedom and to developing democracy. It is not only the cornerstone of democracy, but indispensable to a thriving civil society.”

“The arbitrary action by the Federal Government and its agents have negatively impacted millions of Nigerians who carry on their daily businesses and operational activities on Twitter. The suspension has also impeded the freedom of expression of millions of Nigerians, who criticize and influence government policies through the microblogging app.”

“The suspension of Twitter is arbitrary, and there is no law in Nigeria today permitting the prosecution of people simply for peacefully exercising their human rights through Twitter and other social media platforms.”

“The suspension and threat of prosecution by the Federal Government constitute a fundamental breach of the country’s international human rights obligations including under Article 9 of the African Charter on Human and Peoples’ Rights and Article 19 of International Covenant on Civil and Political Rights to which Nigeria is a state party.”

“The suspension has seriously undermined the ability of Nigerians and other people in the country to freely express themselves in a democracy, and undermined the ability of journalists, media houses, broadcast stations, and other people to freely carry out their professional duties.”

TECH DIGEST – President Muhammadu Buhari on Wednesday received the first made in Nigeria cell phone, known as ITF Mobile.

The News Agency of Nigeria (NAN) reports that the Minister of Industry, trade and Investment, Adeniyi Adebayo, presented the phone to the president, before the commencement of Wednesday’s Federal Executive Council meeting in Abuja.

According to Adebayo, the phone is one of the 12 cell phones produced, using locally sourced components, by the Electrical/Electronics Technology Department of the Industrial Training Fund’s (ITF) Model Skills Training Centre.

He said: “Twelve indigenous mobile cell phones produced by the Model Skills Training Centre of the Industrial Training Fund; an agency under Ministry of Industry Trade and Investment was launched.

“It gives me great pleasure Mr President, to present you with one of the phones.”

NAN reports the president also presided over the swearing-in of one Commissioner each, for the National Population Commission (NPC) and the Federal Civil Service Commission (FCC) ahead of deliberations at the cabinet meeting.

Those sworn-in were Wakil Bukar as Commissioner of the FCC and Mohammed Dattijo Usman as Commissioner of the NPC.

Bukar replaces the FCC Commissioner from Bauchi State while Usman replaces the NPC Commissioner from Niger.

NAN observed that the representatives from the two states died recently.

Meanwhile, President Buhari is presiding over the meeting of the Federal Executive Council at the conference room of the First Lady’s office.

Among those physically attending the meeting are Vice-President Yemi Osinbajo, Secretary to the Government of the Federation, Boss Mustapha and Chief of Staff to the President, Prof. Ibrahim Gambari.

Others include the Ministers of Information and Culture, Lai Mohammed; Finance, Zainab Ahmed, Justice, Abubakar Malami and Trade and investment; Niyi Adebayo.

The Head of Service of the Federation, Dr Folasade Yemi-Esan and other Ministers are participating in the meeting from their various offices in Abuja online. (NAN)

TECH DIGEST – The Attorney-General of the Federation, Abubakar Malami (SAN), downloaded Virtual Private Network in order to visit Twitter to deactivate it, The PUNCH can confirm.

This is despite Malami’s threats to Nigerians that using Twitter could land them in jail.

The AGF had posted a photo of his deactivated Twitter account.

However, a critical look at the photo by just clicking on it showed that indeed Malami had accessed his Twitter account with the aid of a VPN.

In a chat with The PUNCH on Tuesday, a human rights lawyer, Inibehe Effiong, described the AGF as a hypocrite.

Effiong said Malami, who is the chief law officer of the nation, had done nothing but undermine the constitution he ought to protect.

He added, “What Malami has done is not illegal because there is no law that makes it an offence to use Twitter but it only shows the character flaw of Malami. If he is threatening Nigerians, he should have led by example. One would have expected him to be honest. It shows the hypocrisy and how unserious the AGF is.

“He is supposed to be the chief law officer. He is not the AGF of the executive but the federation and so his position on things should be devoid of partisanship or primordial sentiments. He has done nothing but bastardise the rule of law. He is a senior advocate but what sort of example is he setting for others?”

TECH DIGEST – Governors of Kaduna and Ondo states, Nasir El-Rufai and Rotimi Akeredolu respectively, have defied the federal government’s directive suspending activities of Twitter in Nigeria.

Both governors, who are also members of the ruling All Progressives Congress (APC), have made tweets through their verified accounts, daring the prosecution threats made by the Attorney-General of the Federation and Minister of Justice, Abubakar Malami.

Mr El-Rufai, at exactly 9:37 p.m. on Sunday, shared an opinion article titled “Based Nigeria: African country teaches US lesson in how to handle Big Tech tyranny”.

The article, authored by Nebojsa Malic, a Serbian-American journalist, justified the ban on Twitter, nudging the United States to learn from the move by the Nigerian government.

“Nigeria is a far more serious and ‘based’ country than the US, at least if President Muhammadu Buhari’s response to Twitter censorship, compared to that of Donald Trump’s,  is anything to go by,” Mr Malic wrote.

Governor Akeredolu, on the other hand, posted a statement reacting to the night attack that claimed several lives in Igangan community in Oyo State on Sunday.

He was reacting to the killings in his capacity as the Chairman of Southwest Governors Forum.

“We, on our part, are resolved to defend our people, their property, and all legitimate means of livelihood against both internal and external aggression. On this, there will be no compromise,” the statement read.

Government sources told PREMIUM TIMES that Governor El-Rufai has been outside the country for over a week. Although the source did not disclose his location, he said “the activities of Twitter is not banned in the country.”

When contacted, the spokesperson of Governor Akeredolu, Olabode Richard, said the microblogging platform was accessible to Nigerians on Sunday, adding that his principal did not make use of the Virtual Private Network (VPN) or other alternatives being explored by Nigerians.

He promised to give further response but was yet to reach out to our reporter as of the time of filing this report.

It however remains unclear if the order from the office of the Attorney-General of the Federation will be effected on Messrs El-Rufai and Akeredolu.

Mr Malami had directed the Director of Public Prosecution of the Federation (DPPF) in his office, “to swing into action and commence, in earnest, the process of prosecution of violators of the Federal Government De-activation of operations of Twitter in Nigeria.”

“Malami directed the DPPF to liase with the Ministry of Communication and Digital Economy, National Communication Communication (NCC) and other relevant government agencies to ensure the speedy prosecution of offenders without any further delay, ” Mr Malami’s publicist, Umar Gwandu, had said on Saturday.

Recall that Information Minister Lai Mohammed, announced a ban on activities of the microblogging platform on Friday.

Mr Mohammed also disclosed that the federal government had ordered the National Broadcasting Commission (NBC) to “immediately commence the process of licensing all OTT and social media operations in Nigeria.”

Owing to the ban, Nigerians have been denied access to Twitter and can only access by bypassing domain restrictions through alternative media.

The suspension was sequel to Twitter’s deletion of President Muhammadu Buhari’s controversial tweet about the civil war after some Nigerian users flagged it.

The government, in its response, accused the platform of bias against President Buhari and undermining Nigeria’s corporate existence.

Although the presidency says the ban is temporary and an attempt to curb fake news, human rights and foreign missions have berated the President Buhari-led administration for censorship, calling for a reversal of the suspension

TECH DIGEST– Attorney General of the Federation and Minister of Justice, Abubakar Malami, SAN has directed the immediate prosecution of violators of the Federal Government’s ban on Twitter operations in Nigeria.

This was announced in a statement issued by the Office of the Attorney General of the Federation and Minister of Justice on Saturday.

Spokesperson of the Ministry, Umar Jibrilu Gwandu said the AGF has directed DPPF to swing into immediate action and commence prosecution of the violators of the ban.

“Malami directed the Director of Public Prosecution of the Federation (DPPF) at the Office of the Attorney General of the Federation and Minister of Justice, to swing into action and commence in earnest the process of prosecution of violators of the Federal Government De-activation of operations of Twitter in Nigeria.

“Malami directed the DPPF to liase with the Ministry of Communication and Digital Economy, National Communication Communication (NCC) and other relevant government agencies to ensure the speedy prosecution of offenders without any further delay,” the statement read in part.

The Federal Government of Nigeria on Friday announced the indefinite suspension of Twitter in the country.
The Minister of Information and Culture, Alhaji Lai Mohammed while announcing the suspension cited the persistent use of the platform for activities that are “capable of undermining Nigeria’s corporate existence.”

Following the announcement, telecom operators in Nigeria blocked Twitter leaving users in the country unable to access the microblogging website while some navigated the hurdle using Virtual Private Networks (VPN).

This will democratize government service delivery thereby ensuring accountability, simply because records are being kept and can be checked at anytime needed”.

The Minister revealed that his Ministry is working towards curbing sharp corrupt practices which are stunting the growth and development of the country.

“There is an urgent need to work out strategies and policies that will mitigate such act. This will pave ways for speedy development of the country,” he remarked.

Dr Pantami assured the organisers that the Ministry is in full support of the activities of Code of Conduct Bureau that aimed at tackling and eliminating corruption practices across the country with the motive of creating an enabling environment for transparency and accountability of the activities of government.

The Minister of Justice and Attorney General of the Federation, Barrister Abubakar Malami (SAN) in his remarks applauded the organizers of the seminar for putting up the event at a time such is needed to deepening the anti-corruption war of the government.
While disclosing that war against corruption is one of the cardinal point of the administration, Barrister Malami restated the critical and vital roles of CCB in building a corrupt free nation.
Malami said that there is need to make government operations and processes open and transparent. This, he said would ensure accountability.

The Chairman, Code of Conduct Bureau, Prof. Isah Mohammed stated that seminar was the first of it’s kind in the history of the organisation adding that its objective is to reduce corrupt tendencies at the recovering stage of COVID 19.

He said, “This Bureau was established in response to the allegations of corruption against government operations in the 1960s, 1970s, and 1980s which resulted in coup and counter coups with trillions of money stolen from both domestic and foreign bodies as a result of corrupt practices by public office holders and till date we are still striving to eliminate the scourge.

Mohammed asserted that there is need to join hands and work together to crackdown on corrupt activities which is affecting the operations and processes in country. He therefore advocated for entrenching strategic policies that will reduce corrupt practices for attainment of goals and aspirations of the country.
